Biden Admin Moves To Fund Canadian Mines While Blocking US Mining Efforts

• The Biden administration is considering funding the Canadian mining and metal industry as it is desperate to acquire more rare earth minerals to build renewable energy technologies; however, the administration has previously blocked the development of U.S. mining efforts, according to E&E News.
• The move to acquire minerals from outside the U.S. comes amid the Biden administration’s repeated efforts to prevent domestic mining developments. The Environmental Protection Agency (EPA) announced in May that it would review a proposal that dealt a significant blow to the Pebble Project, an Alaska mining project that would produce about 1.5 billion tons of critical minerals over 20 years. Additionally, Biden’s Interior Department (DOI) canceled two mineral leases belonging to the Twin Metals Mine in Minnesota in January, halting the mine’s construction.

Paul Pelosi gets 5 days in jail, 3 years of probation in DUI

•   The husband of U.S. House Speaker Nancy Pelosi pleaded guilty  to misdemeanor driving under the influence charges related to a May crash in California’s wine country and was sentenced to five days in jail and three years of probation.

• Paul Pelosi already served two days in jail and received conduct credit for two other days, Napa County Superior Court Judge Joseph Solga said. Paul Pelosi will work eight hours in the court’s work program in lieu of the remaining day, Solga said during Paul Pelosi’s sentencing, which he did not attend.
• State law allows for DUI misdemeanor defendants to appear through their attorney unless ordered otherwise by the court.

• As part of his probation, Paul Pelosi will also be required to attend a three-month drinking driver class, and install an ignition interlock device, where the driver has to provide a breath sample before the engine will start. He will also have to pay nearly $7,000 in fines, the judge said.

Federal Judge Rules Biden’s Oil and Gas Order Violated the Law, Issues Permanent Injunction in States That Sued 

• A federal judge   issued a permanent injunction that will allow new oil and gas leases on federal lands.
• The ruling by Judge Terry Doughty of the Western District of Louisiana came one day after the Fifth Circuit Court of Appeals had kicked back to Doughty an injunction he issued last year to accomplish the same goal, according to The Hill.
• Doughty’s Thursday ruling permanently blocks a January 2021 executive order from President Joe Biden that halted lease sales on federal lands.

• The order applies to Alabama, Alaska, Arkansas, Georgia, Louisiana, Mississippi, Missouri, Montana, Nebraska, Oklahoma, Texas, Utah and West Virginia, which sued Biden.
• Under the law, the Biden administration must reinstate $192 million in leases for the Gulf of Mexico. The law also requires two lease sales in the Gulf of Mexico and one in Alaska before October 2023.
• The law also links renewable energy leases from wind or solar projects to a requirement that the Department of Interior offer oil and gas leases for a minimum of 60 million offshore acres and 2 million onshore acres.

Germany fails to find replacement for Russian gas – Die Zeit

• Attempts by German Chancellor Olaf Scholz to secure Canadian gas in order to reduce the EU’s reliance on Russian energy have been unsuccessful, Die Zeit newspaper reported on Tuesday.
• Scholz met with Prime Minister Justin Trudeau in Montreal on Monday to discuss the idea of shipping some of Canada’s abundant natural gas across the Atlantic to terminals in Germany.
• However, Trudeau appeared to pour cold water on such an idea, according to the report.
• He then pointed out that natural gas would have to be shipped by pipeline from the fields of Western Canada to a still-unbuilt liquefaction terminal on the Atlantic coast. That would be a costly undertaking and might not be a prudent investment, given Europe’s commitment to rapidly transitioning to clean energy, noted Trudeau.

•   House Democrats are urging social media companies to address the spike in calls for violence against law enforcement on their platforms in the aftermath of the Mar-a-Lago raid. “We are concerned that reckless statements by the former President and Republican Members of Congress have unleashed a flood of violent threats on social media that have already led to at least one death and pose a danger to law enforcement officers across the United States,” the letter signed by Rep. Carolyn B. Maloney of New York, the chairwoman of the House Oversight Committee and Rep. Stephen F. Lynch of Massachusetts, thee chairman of the National Security Subcommittee, reads. “We urge you to take immediate action to address any threats of violence against law enforcement that appear on your company’s platforms. Court Rules Taxpayers Can Sue IRS For Violating Constitutional Rights On Data Collection

A three-judge panel of the U.S. Court of Appeals for the First Circuit has unanimously ruled in Harper v. Rettig that taxpayer James Harper can take the Internal Revenue Service (IRS) to federal court for gathering private financial information about his use of virtual currency from third-party exchanges without a lawful subpoena.

Judge Kermit Lipez, writing for the majority, rejects IRS’s argument that the AIA bars Mr. Harper’s suit because it seeks to restrain activities related to the assessment or collection of taxes. He notes that CIC Services provides clarity that “information gathering” is a “phase of tax administration procedure that occurs before assessment [or] collection.” Judge Lipez concludes that since IRS’s activities against Mr. Harper “clearly fall within the category of information gathering … the [AIA] is not an applicable exception to the United States’ waiver of sovereign immunity.” Indeed, as the Supreme Court explained in CIC Services, where, as here, there is no “tax penalty” at issue, then the case is a “cinch,” and “the suit c[an] proceed.”

Mr. Harper had contracted with third-party virtual currency exchanges to protect his private information against unlawful government intrusion. Despite his efforts to ensure his records were properly safeguarded, IRS took the data of Mr. Harper and thousands of other cryptocurrency holders from virtual-currency exchanges without reasonable suspicion and without providing a pre-data-collection notice and opportunity to contest IRS’s dragnet operation. In ruling that the district court has subject-matter jurisdiction, the First Circuit has ensured that the IRS can be held accountable for this violation of Harper’s Fourth and Fifth Amendment constitutional rights.

Russian Defense Ministry: Proof of Ukraine’s ‘Chemical Terrorism’ to Be Sent to OPCW Soon

NIH Inspector General Finds More Than Half of Clinical Trials During Covid ‘Did Not Comply’ with Federal Requirements 

• The National Institutes of Health’s Office of the Inspector General has found that more than half the clinical trials funded in response to the Covid-19 pandemic did not comply with federal guidelines.
• The OIG report, which was released earlier this week, sheds light on the lax approach that the nation’s premier health institutes took to ensure that the clinical trials met the highest standards for transparency and timely reporting.

• “We reviewed all 72 NIH-funded Intramural and Extramural clinical trials for which Federal law and NIH policy required the results to be reported in calendar year 2019 or 2020,” the NIH’s Inspector General stated. “To determine whether responsible parties complied with reporting requirements, we compared the date the results should have been submitted with the date they were submitted. We also determined whether NIH posted the clinical trial results submitted by the responsible parties to ClinicalTrials.gov within 30 days of the submission date.”
• The NIH’s IG found that more than half the clinical trials did not meet the requisite federal reporting guidelines, either by failing to meet the deadline or by not reporting the results at all. The Table summarizes the number of clinical trials requiring results to be submitted in 2019 or 2020 that were submitted on time, late, or not submitted at all.

Citizens United Sues Biden Administration Over Election-Takeover Documents

• Citizens United filed two lawsuits this week against the Department of Interior and Department of State for failing to comply with Freedom of Information Act (FOIA) records requests regarding the White House’s attempt to federalize elections.
• The nonprofit submitted FOIA requests in June, but both agencies failed to respond (federal law requires FOIA requests to be responded to within 20 working days). The requests sought email and text messages from both agencies that mentioned President Biden’s Promoting Access to Voting executive order and the Hatch Act, a law that prohibits executive branch employees from engaging in election activities.

By the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby direct the following:

Section 1.  Declassification and Release.    At my request, on December 30, 2020, the Department of Justice provided the White House with a binder of materials related to the Federal Bureau of Investigation’s Crossfire Hurricane investigation.  Portions of the documents in the binder have remained classified and have not been released to the Congress or the public.  I requested the documents so that a declassification review could be performed and so I could determine to what extent materials in the binder should be released in unclassified form.

I determined that the materials in that binder should be declassified to the maximum extent possible.  In response, and as part of the iterative process of the declassification review, under a cover letter dated January 17, 2021, the Federal Bureau of Investigation noted its continuing objection to any further declassification of the materials in the binder and also, on the basis of a review that included Intelligence Community equities, identified the passages that it believed it was most crucial to keep from public disclosure.  I have determined to accept the redactions proposed for continued classification by the FBI in that January 17 submission.

I hereby declassify the remaining materials in the binder.  This is my final determination under the declassification review and I have directed the Attorney General to implement the redactions proposed in the FBI’s January 17 submission and return to the White House an appropriately redacted copy.

My decision to declassify materials within the binder is subject to the limits identified above and does not extend to materials that must be protected from disclosure pursuant to orders of the Foreign Intelligence Surveillance Court and does not require the disclosure of certain personally identifiable information or any other materials that must be protected from disclosure under applicable law.  Accordingly, at my direction, the Attorney General has conducted an appropriate review to ensure that materials provided in the binder may be disclosed by the White House in accordance with applicable law.

Sec. 2.  General Provisions.   (a)  Nothing in this memorandum shall be construed to impair or otherwise affect:

(i)   the authority granted by law to an executive department or agency, or the head thereof; or

The Fed Issues a Warning to Member Banks about Engaging in Crypto Activities

• The Fed sent a letter yesterday to supervisory staff at its 12 regional Federal Reserve banks and to all Fed member banks. The letter started out with a curious sentence (potentially crafted to assuage the loud-mouthed crypto hawkers which include a significant number of right-wing members of Congress on the Senate Banking and House Financial Services Committees which oversee the Fed). The sentence read:
• “The emerging crypto-asset sector presents potential opportunities to banking organizations, their customers, and the overall financial system…” (Italics added.)
• The word “opportunities” typically suggests that something of a positive nature might transpire. But the letter from the Fed fails to mention so much as one positive development that might occur from banks engaging in crypto activities. Instead, it correctly outlines a multitude of nightmare scenarios that can – and have – occurred from engaging in crypto activities.
• The Fed lists the following:
• “novel risks such as those associated with cybersecurity and governance”;
• “money laundering and illicit financing”;
• “significant consumer risks such as those related to price volatility, misinformation, fraud, and theft or loss of assets”;
• “uncertainty regarding the legal status of many crypto-assets; potential legal exposure arising from consumer losses, operational failures, and relationships with crypto-asset service providers”;
• “limited legal precedent regarding how crypto-assets would be treated in varying contexts, including, for example, in the event of loss or bankruptcy”;
• “risks to financial stability including potentially through destabilizing runs and disruptions in the payment systems.”
• After more than making the case that crypto shouldn’t come within a ten-mile range of taxpayer-backstopped, federally-insured banks, the Fed then punts and simply requires banks to do the following before engaging in crypto activities:
• “A supervised banking organization should notify its lead supervisory point of contact at the Federal Reserve prior to engaging in any crypto-asset-related activity. Any supervised banking organization that is already engaged in crypto-asset-related activities should notify its lead supervisory point of contact at the Federal Reserve promptly regarding the engagement in such activities, if it has not already done so. Federal Reserve supervisory staff will provide relevant supervisory feedback, as appropriate, in a timely manner.

• The Army transferred some of its satellite operations to the Space Force on Monday, marking the latest move to reorganize and grow the youngest military branch.
• In addition to control of the communication satellites, 500 people will transfer from the Army’s Space and Missile Defense Command, based in Huntsville, Alabama, to Schriever Space Force Base in Colorado as part of the expansion.

• The way censorship is done these days is that each Internet platform, such as Twitter, has its own moderation team and a decision making engine. Twitter would only look at tweets by any specific twitter user, when deciding on whether to delete any tweets or suspend their authors. Twitter moderators do NOT look at Gettr or other external websites.
• So, for example, user @JohnSmith12345 may have a Twitter account and narrowly abide by Twitter rules, but at the same time have a Gettr account where he would publish anti-vaccine messages. Twitter would not be able to suspend @JohnSmith12345’s account. That is no longer acceptable to the WEF because they want to silence people and ideas, not individual messages or accounts.
• This explains why the WEF needs to move beyond the major Internet platforms, in order to collect intelligence about people and ideas everywhere else. Such an approach would allow them to know better what person or idea to censor — on all major platforms at once.
•  WEF collecting information on everyone everywhere, and then telling all platforms what posts to remove, based on a global decision-making AI engine that sees everything and can identify individual people and ideas beyond any given platform.
